These Terms of Service ("Terms") govern your access to and use of the Elastic Docs website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms, and that you are at least 18 years old or the age of majority in your jurisdiction. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Description of the Service
Elastic Docs provides a documentation platform for authoring, reviewing, publishing, and exporting content. We may add, change, or remove features at any time, and we may suspend or discontinue the Service, in whole or in part, with reasonable notice where practicable.
3. Accounts and security
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to provide accurate information, keep it current, and notify us promptly of any unauthorized use or security breach. We are not liable for any loss arising from your failure to protect your credentials.
4. Acceptable use
You agree not to, and not to permit others to:
- Use the Service in violation of any applicable law or regulation.
- Infringe the intellectual property, privacy, or other rights of others.
- Upload malware or attempt to disrupt, overload, or impair the Service.
- Attempt to gain unauthorized access to any systems, data, or accounts.
- Reverse engineer or resell the Service except as permitted by law.
- Use the Service to store or transmit unlawful, harmful, or abusive content.
5. Your content
You retain all ownership rights to the content you create, upload, or publish through the Service ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, display, and transmit Your Content solely to operate and provide the Service. You are responsible for Your Content and for ensuring you have the rights necessary to use it with the Service.
6. Intellectual property
The Service, including its software, design, and trademarks, is owned by Elastic Docs and its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service.
7. Third-party services
The Service may integrate with or link to third-party services (for example, source control providers or AI model providers). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.
8. Fees and payment
Paid plans are billed in accordance with the pricing presented to you at the time of purchase. Unless otherwise stated, fees are non-refundable. We may change pricing with reasonable advance notice, effective at the start of your next billing period.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use poses a risk to the Service or others. Upon termination, your right to use the Service ceases. Sections intended to survive termination (including ownership, disclaimers, and limitation of liability) will continue to apply.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of liability
To the maximum extent permitted by law, Elastic Docs and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Elastic Docs from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms with a new "Last updated" date. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Elastic Docs is established, without regard to its conflict-of-laws principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.
